    I did think of that at the time, but the issue had just been going on and on (14 years on record) and the SC were completely ignoring decisions that had been made previously…  I was secretly hoping that there was something in the Strata Management Act that stated I could recoup legal costs, otherwise I know that the Strata Manager wouldn’t oblige.

    Just in relation to this thread, I am an owner/occupier in a block of 18 units that was built in 1963. 

    I was advised by a builder a little while ago, that the internal banisters in our common stairwells are non compliant (do not meet with height regulations).  He advised me that are required to be 900mm in height but are less than this.  Given the above, would it be that they do not need to be replaced until a point where they break and then are replaced with banisters compliant with current standards?

    I’ve just received my Notice of Meeting for our upcoming AGM on 24  August.  In regards to the Strata Committee it has listed the motion as being:

    • nominations for members of the SC be called and received
    • the number of members of the SC be determined and;
    • the SC be elected

    Would it stand to reason that I’d still only be able to get two people onto the SC through a poll vote?

    Thanks very much for that.  Just in relation to voting with a proxy, the Dept of Fair Trading states:

    There are limits on the total number of proxies that can be held. The limits held by one person are:

    • one proxy vote only for schemes with 20 lots or less, or
    • a number that is equal to no more than 5% of the total number of lots if the scheme has more than 20 lots.

    If my strata schemes has 18 units and 4 garages, does that mean that it is deemed to be having more than 20 lots?

    I meant does the person who attends the meeting on behalf of the absent owner need to be another owner in order to be able to act on all motions at the AGM.  I am arranging for the absent owner to get something in writing to say that they wish to join the SC, so hopefully that will cover that off.

    Thanks for that.  On speaking with the PA to the strata manager, she tried to persuade me to get it from the Secretary, even after I told her that he wouldn’t give it to me.  I’ve made an appointment to see the strata records, but I got the feeling that they were going to obstruct me.  I’m glad I can quote two types of legislation now.

    Thanks very much for this.  Greatly appreciated.  I have found out yesterday that the other owner that I wished to form the SC with, is possibly unable to attend the AGM.  It is more beneficial for her to be there or if I have her proxy it wouldn’t matter?  How would this work?

    Thanks for that.  So that would mean that I couldn’t vote for the other owner to have a position and she couldn’t vote for me?  

    I was hoping to cap the positions on the committee to three, with myself and the other owner being two of these three.  We currently have six and we are both two of the six and I was only able to get us on previously by calling a poll vote.  The rest of the committee are rusted on members, with the Secretary being in their role for the last ten years.  I believe it is well overdue for a change.

    Question in relation to this thread.  Myself and one other owner have a fair amount of unit entitlements as a result of our properties.  I am wishing to have a new SC elected at the next AGM.  Can I vote for myself as say, Secretary and use the other owners proxy for the count?  Or does someone need to nominate me?

    Just in relation to this thread… I wish to place a motion on our upcoming AGM for the removal of our strata committee.  I understand that this needs to be done by a special resolution.  Anyone’s assistance on wording ie sections of the Act to quote, would be greatly appreciated.
