hi Maltman. I’m really sorry to hear of your plight and will watch with interest as we seem to be developing a similar situation in our small block.
We have had discussions about how to handle the situation. We have always thought it would be best to call social services who might also operate from the local council. https://www.ncoss.org.au/ might also have some resources. I’ll do some research and ask around as well.

hello all, we are on the top floor of a block of 6, and with our top floor neighbour, we are planning to extend our units in to our very adequate roof space.
We had an initial chat with the OC at our recent AGM and there seemed to be broad support. We have now engaged a structural engineer to look at the space and provide a report.
What I would like to know – to get the formal approval of the OC and to have a by-law passed to allow each party sole use of the space above their unit – is there a guideline available on what exactly is needed to present to a GM of the OC? Is there mention of this made in the Strata Schemes development act? (I couldn’t see it on browsing) or available somewhere else?
Our strata manager said: engineer’s report, architectural plans, valuers report to help assess what might be payable to OC. Oh – yes, and a by-law!
We realise we are on a long path towards actually breaking into the roof space, and want to ensure it’s all done by the book and with consideration for our neighbours. Once we have the approval – then the DA fun begins. On this note, we also understand from our SM that council may request fire compliance be re-checked…. any advice on this would also be welcome. In the past 5 years we have upgraded our emergency lighting and exit signs etc. There are smoke detectors in all units and fire doors on the front door of each unit.
I realise this may well be opening a can of worms but hope there are some knowledgeable and learned insights to be had here.

We are planning an attic conversion into the ceiling above our unit, and our Strata Manager has noted: “It should be noted that Council will most definitely impose on the Owners Corporation to upgrade their fire safety requirements, this cost would be the liability of the Owners Corporation and without seeing the terms of the schedule, would suggest that this cost alone would be between $30,000 – $50,000.” Ouch!!!!
You have said in the article – – “The first thing you might do as a group is hire a building consultant experienced in negotiating councils away from their Rolls Royce fire safety measures and towards a Toyota Corolla solution”
I presume the costs mentioned above would be the Rolls Royce type – most definitely only need a Corolla here! Could you please suggest the next steps required? and where we might find the building consultant experts required? What type of consultant would this be?
BTW: we are a block of 6, double brick construction, built in 1930s. About 5 years ago we upgraded our common property lighting, fire alarms, exit signs and emergency lighting in common areas and new fire doors on each level. What are the types of upgrades that might be needed above and beyond these fixtures?

thanks everyone. it does seem that the cost is to cover an EGM and the associated by-laws.
i still think it’s overkill…. but the mix of owners and tenants in this building make it easier to negotiate through the SM. so they paid…. let’s hope they got a positive response!

I have written asking for evidence of damage, and for a complaint to be made in writing. so far it is all hearsay. I will also be seeking an expert opinion on the building’s condition on that side of the structure.

I agree it’s easiest to get a building inspection done but I fear that even that won’t appease the
crackpotsunbelievers in our midst! If it is found to be adequate ventilation in the building (and there was no problem reported until this person bought in in 2015) then how do we convince an ageing owner that they really should be opening their windows at all times? We have security bars installed on the ground floor units affected.One option would be to install additional vents to the outside but this is probably going to be unsightly from outside and inside.
I guess my real concern is that this owner will become unreasonable and vindictive, already being quite forgetful and shut in. How does one cope with single aged owners with no visible means of social support?
