      Common property is common property. If the owner of the unit is cashing in on the extra rent, that is illegal. If the owner is prepared to pay for that parcel of land, so that parking spot becomes part of the owner’s unit, then that’s fine. The owner will have to approach the committee and ask if he can pay for the land the vehicle is parked.

       

      Otherwise, it’s common property, and the committee can inform the owner it’s illegal, or if you make an agreement, all the rent received from the tenant for that parking spot, it should be forwarded to the Strata Bank Account.

       

      Get everything in writing as well.

        It’s not illegal to take a photograph of a motor vehicle in common property, although it’s private land. It becomes illegal if used for commercial purposes, etc. As evidence, it’s not illegal.

         

        I would ask the person saying “it’s illegal” to show you where in the legislation is states this. The fact is, it doesn’t, but ask anyway.

          From an original quote of $280K to around $500K? Your Strata Manager is totally at fault. Can you take them to the Department of Fair Trading (DoFT) for Unethical Conduct?

           

          As well, why didn’t the owners including yourself take the builder to the DoFT in the first place and repair the building?

           

          When our Strata Manager mentions anything, I do my due diligence to investigate. In other words, with the original quote of $280K, I would have got 2 more quotes. No repair job’s price drops, Olympic Games or not.

           

          We had some painting performed, and we chose the painter that was not recommended by the Strata Manager. He was a lot cheaper, very professional and did not charge extra if he had to come in on Saturdays.
