      Hello All,

      What happens if you do not have an executed agreement? The old agreement expired in September and our SM forgot to get a new agreement executed.

      The EC tried to replace the SM at the last AGM however they arranged proxies and the vote for the replacement SM was defeated.

      Thank you for your advice.

          Jimmy,

          One additional question.

          Is it a requirement that action in the NCAT against 65A breaches need to be approved at a general meeting or should a SM automatically seek that course of action?

                    Would this not be a similar problem to that mentioned in the thread “Who is responsible?”

                    In that thread (CLICK HERE) it was a very similar situation and the common view was that it was the responsibility of the OC.

                     

                    Would that not be the situation in this case?
