Hi All,
I know a lot of tenants renting who take more care and are much better residents than owners. But having said that, many decisions made by the EC are made considering the finances of the OC and I feel that some tenants would not really feel these decisions in the hip pocket as they may not be paying levies and special levies, rates ,etc.. but looking at and rather considering the amenity of their tenancy. For these reasons I do not believe it a good idea to have resident tenants/renters on the EC making decisions for the Owners Corp.

Similar situation, been down the legal road n now the new Owners after 3 years of using CP, 50ish sqm no levies, no cost to them, will only do Exclusive Use and pay a stupidly minimal amount and no future levies!! on a sq. meterage not too far off the size of my apartment that they have stolen! My quarterly levies r $900, no pool, nothing, one lift. Our lawyer says we only have one option, bylaw Exclusive Use and no levies. Does not make sense to me,, I would rather see the area removed! These thieves have had use of 50sqm for 3years!
Whale, what is the annual payment you speak of?
I would give .. like to say my right arm but I would just be being silly, to find a way to get some money in our coffers from these thieves.

Your situation Jef is clearly different. I would call Syd Water but bet you have already done that?
Why the energy suppliers go to the trouble of reading any meters at all by a representative when clearly the technology is here to read meters wirelessly Is beyond me. Stagger out the new metering, cost could be limited.
Our gas meters in my lot are read automatically. Why aren’t all units now metered separately by all utility companies? I personally would approve. And in fact the cost would lie with these providers which is probably why we are still living in the stone age.
I can find my mobile fone when it is lost by simply clicking on an app! Go figure!

So true Whale. If the meters are actually read.
I recently did a test. Read the meter every few days, recorded and then compared with our bills, over 2 years. Mind u my property is 24 residential and 4 commercial.
I then contacted Sydney Water w my calculations and received a $3000 refund for our building.
Syd water were not reading the meter at all. They were averaging our bill.
Probably still are!

Similar in our building. I have always adjusted the door closer myself as even the fire inspection guys don’t. Have requested it to be done….Nothing.
Any failure though of any element of the front door fire door of ones apartment has always been OC responsibility.
Recently we received our notice of fire inspection, an added note was that any failure of closures above doors would now be the lot owners responsibility. No meetings, no notice, no nothing. Go figure. Maybe the new legislation covers? Strata living is still such a grey area of laws and the interpretation of them in my mind. Have yet to bail SM up about this issue.

Hi All,
This makes no sense to me at all. I was under the impression that these types of leases were illegal?
In my lot we are recently having owners using some type of website called air bnb. Do you know this? They are renting out spare rooms, space etc.,
Loads of strangers in the building and no communication to either OC, SM, EC so as usual no communication to the residents or people who actually live on the property.

Totally agree with cosmos reply.
My feeling is you can attempt to sue whomever you want but you need to prove negligence or.. whatever.
What is the situation? It depends.
Are you asking if the SM and the EC can sue one member of the EC?
The EC and the Strata Manager are two different units, but one. The EC instructs the SM on behalf of the OC.
The EC votes so any result can not be held to one person. No one person in any strata is responsible. This is what committees are for, they are an entity.
Do you have some issue with one person?
In my building the EC are insured for 1 million. The EC are purely volunteers.
But can be held responsible as a whole hence the insurance.
The Strata managers are trained managers.
Who do you want to sue and for what?
