I understand the fencing rules are pretty universal throughout Oz for strata namely
Dividing Fences within the scheme land are determined to be maintained in the following way:
- The perimeter fence of the scheme land is a shared responsibility of the Body Corporate and the property owner of the adjoining property
- A dividing fence between common property and a lot is a shared expense of the owner of the lot and the Body Corporate
- A dividing fence between two lots is an equal contribution between the two lot owners
However on our strata plans (QLD) ALL (even between 2 lots) the fences are shown as a solid black line indicating Strata responsibility.
When in doubt you generally refer to the Strata plans, but what if they contradict an ACT. Is their a similar situation where if the plans conflict with an Act the plans loose (like a bylaw looses if it conflicts with a higher law).
I suspect our plans were drawn up by a trainee on a Friday after a liquid lunch when his mind was on his hot date for the evening.
