I am trying to locate the content of a previous post, where I’m sure I read that an OC was being sued by a trades person for coninued harassment by an owner.
I’m interested in this because currently we have a situation in our complex where a tradesperson is attending regularly, doing the work requested and is very easy to deal with. However he has a dog which follows him around, causes no trouble and is well-accepted by others residing here. There is one owner who has taken an extreme dislike to the dog, possibly due to a previous issue with dogs. However they are now making unfounded allegations about the dog we are in danger of losing our tradesperson. There was also a witnessed episode where this dog was approached in a hostile and provocative manner by this owner.
What are the liabilities of the OC if any injury had occurred, and are we liable if the tradesperson decides that he is being harrassed and wants to litigate against the OC?
