      I have rented an apartment in Victoria, this is the rear part of a High Street business. The problem is the accommodation is classified as commercial premises, not as a mixed dwelling by the local council. This means I have no right to have my own bins or complain about the business next door that is breaking the rules of their planning permission. It is a band practice studio which is very noisy that is affecting my health. I have no rights because I should not be there.
      My question is does this situation constitute a failure of my renting agent. He seems unwilling or unable to resolve the planning issue of my apartment. Does this issue give me the right to cancel my rental agreement as it appears the only real solution is to move? Will I get my bond back?
