I am not sure at all where this topic should go, so apologies if I have picked the wrong section.

The highrise strata building I live in has three street frontages.  I would like to take photographs of the exterior of the building from two of those street frontages.  The photographs would be taken while standing on a public street, and would basically show the balconies and windows of apartments, but not so close that residents could be seen.

It is my intention to scrutinise the photos carefully, so that residents are not inadvertently included, and publish them on a website or Facebook.  The purpose of this is to invite people to assess whether or not the building has a uniform look as a whole, as a result of occupancy.

I really don’t know what law this is covered by.

    Thank you.

There are no laws which generally prohibit the taking of photos in public places (ask Nicole Kidman) although there may be some limitations of what you can do with them.

Just google “public photography in NSW (or whatever state you are in)” and you will find lots of legal opinions on the matter.

Boronia is right – people can even film the inside of your home from outside your property, provided it is not for salacious or illegal purposes.

If this is a permanent or semi-permanent installation properly authorised by the EC (therefore a ‘corporate’ installation) under Health & Safety laws there has to be signage warning workers.

If it’s on Common Property, permission should be given by the EC.

But an individual taking action on his or her own to solve a problem may be a good thing, provided you can get assurances that the camera is not pointed at your budgie smugglers.

The opinions offered in these Forum posts and replies are not intended to be taken as legal advice. Readers with serious issues should consult experienced strata lawyers.
