Sorry for adding this here, but I had no idea where I should ask this question.

With the changes to the Home Building Act, I keep seeing the word “retrospective” used.

I would like some clarification as to how far retrospectively? We moved into our apartment two years ago, does this mean our time is up?

Seems ridiculous, when we bought off the plan in 2010 and moved in, in 2012. We bought thinking we had 6 years for major defects and that still applied in 2012 when we settled & moved in.

Thanks in advance for any clarification.

Thanks Whale, I guess we’re stuffed then.

Can you imagine if you bought a car with a five year warranty and then after two years the manufacturer called you and said “we have just decided to drop our warranty to two years and we are doing so retrospectively, so just calling to let you know your warranty if up.”

It is incomprehensible that a change like this can be retrospective, if they had brought in the 2% developer bond at the same time, would that have been retrospective? I think not!
