It’s fair to say that most if not all of the problems in strata come down to lack of knowledge (or ignorance, if you want to be brutal).
If one party knows a little bit and the other knows even less and they are both taking conflicting positions, there will be tears before bedtime.
In our experience, the professionals who know least about strata law are rental agents. On the resident side, tenants tend to be the less well-informed members of the community, so you can see an obviously fertile ground for disputation right there.
Add in strata committee members who aren’t entirely sure of their ground and it’s not going to get any easier.
One example in this week’s forum concerns a tenant whose car is leaking oil on common property where they shouldn’t really be parking (they have a garage).
Asked to stop the leak and clean up, they have said they don’t have to as the unofficial parking spot comes with their flat and they only have to clean when they move out.
It’s a typical strata hassle where ignorance bumps up against uncertainty – but something has to give. Things have become heated and there have been threats to call the police. Whose side are you on HERE?
