It feels like a minor issue but it could mean a lot of trouble for a strata scheme. Basically, there is a lot of sense, if not legal pressure on owners corporations to only hire licensed and insured tradespeople.
A quick Google search comes up with this: “NSW owners corporations are not required to only employ licensed tradespeople, but they are required to ensure that the tradespeople they use are properly licensed and insured.”
All of which makes very little sense and sems to leave a lot of leeway for OCs to employ mates of friends who have done this before a million times.
But what happens when something goes seriously wrong? Is the owners corp liable? Are the individual committee members?
This story, where the owners corp were found liable for the death of an owner’s employee working on common property, is focussing thoughts on the Forum this week.
Unlicensed and uninsured? Is it worth the risk? Have your say here.
