      Dear Flat Chat, Our large complex has a “visitor only parking” bylaw, abused by some residents, (despite each apartment having a double garage.)   The Strata C/tee will only take action  against offenders if complainant includes his/her identity . Obviously this is a deterrent  to  complaints about perpetual offenders  being reported to SC  The S.C states this is a legal requirement. Can you advise if this is so, & direct me to any legislation or where I can find information stating this is a NSW requirement

        At our strata we used to have the same restrictions.  The committee needed proof.

        Finally it was accepted that a photo showing the time, the offending vehicle and it’s number plate was accepted. So the complainant remained anonymous.

          Speaking as a former committee member, I would have thought that the key to any complaint is evidence and not the name of someone alleging illegal parking.

          Why don’t you photograph the car(s) when parked illegally and in the photo(s) capture say a newspaper’s masthead (which includes the date)?

            It’s a form of bullying. My block recently passed a “name and shame” rule at an AGM at the chair’s insistence, saying that all correspondents to and from the committee MUST be named in the minutes. Next meeting, they (quite rightly) didn’t name someone who was already doing it a bit tough.

            My argument was that if it can be used selectively, it shouldn’t be used at all.  Needless to say, I was named in the minutes.

            There should be a strata law that you provide the Lot Number, at most, if you NEED to identify residents, otherwise it’s just a weapon for control-freak chairs and secretaries (often the same person) to deter complaints and questions.  Hey, it works in Russia, China and the Philippines, why wouldn’t it work in your unit block?

              Thank you for responses. We need to supply  to S.C photo, registration, offenders address plus ,as mentioned, complainant’s ID in case complaint ends up going to NCAT.   Next question, does NCAT need to ID of complainant??It is usually the same  perpetual parking offenders that cause the problems
