      Hi All

       

      We are thinking about taking some form of action against the Strata management company currently managing our building (NSW).  Our Strata manager (an employee of the company in question – I won’t name them) at our last AGM about 6 weeks ago identified that we had been overcharged by the company for our management fees and also he could not account for quite a few Schedule B charges.  The manager, put in a request to the owners of the company for a refund of the management fees and an explanation of the Schedule B fees – but we have not received a reply.  We then separately asked the owners for a date by which our queries would receive a response – again no response.  

      Obviously, we are actively looking for a new Strata manager, but we do not want to sack the incumbents before we get the refund of our management fees at least.  

      Who can we approach to escalate this further?  Is it NCAT? or is there a Strata Ombudsman that can apply some pressure to the company?

        It’s funny how just about everybody involved in strata thinks there should be a Strata Ombudsman … except for the government.  The fact is that if they had one, he or she would be swamped with complaints – many valid, some less so – from day one.

        To answer your question, Strata Managers come under the Stock and Property Agents laws and as such complaints have to be made through Fair Trading.

        Do this as a matter or urgency before this firm disappears up its own off-the-shelf shell company and sells its business and data base to someone else.
