      Hi

      Recently i received an email from the Executrix of the ground floor unit directly below me. She had attached a picture of a wall mounted air conditioning unit above which what appeared to be a localised discoloured mark and she labelled it as a “damp spot”.

      She has asked me to check my air-conditioner for any leaks and check my balcony pots for “overflow”.

      I have ducted air as I am on the top level so no internal mounted unit.My motor sits on the balcony but I have checked all pipes etc for leaks and none. I have had a builder check and all pipes secure and not leaking.All pots have trays to prevent overspill and there are none directly above the common wall in question. I have provided a picture of another Unit with the same on the ground floor and the same damp spot is evident there. She said the ceiling  was painted just before Xmas and this spot has suddenly appeared.

      I enhanced the photo and there was dark spots which appeared to be mold which she denies…said it was a bad photo.

      What are my rights here? As she is the Executrix and not  the owner what if any are her rights? She wants this settled before the tenant moves in..

        Notwithstanding the issues of your neighbour not being an Owner and whether the ducted air conditioning system serving your Lot is yours or common property, you have done everything that can reasonably be expected of you in order to check that the external component of that system is operating correctly, and whilst it’s not clear what the ceiling of your neighbour’s Lot has to do with the matter, your “right” is to ask her to raise all of her concerns with the Strata Manager who’s paid (by both of you) to investigate and to recommend any necessary actions to the Owners Corporation.
